Malpractice
"Medical malpractice" is perhaps more accurately
called "medical negligence". In cases in which
an injury has occurred during the course of medical care,
medical negligence is proved if the injured person or his/her
family shows that the patient has been harmed by the actions
or inactions of a doctor, nurse, therapist, chiropractor,
hospital or clinic.
To successfully proceed in a medical negligence case, a
patient must prove the following elements:
- The healthcare
provider acted negligently
- An injury occurred
- The negligent act played a substantial
part in causing the injury
